Huge thanks to the Honourable Marshall Rothstein C.C., Q.C. for his generosity in spending so much time with us today talking about his judgment in Reference re Broadcasting Regulatory Policy CRTC 2010-167 and Broadcasting Order CRTC 2010-168, 2012 SCC 68, [2012] 3 S.C.R. 489 and its ramifications. During our discussions today we mentioned that this was a 5-4 decision of the Supreme Court of Canada. This was contrasted this to the decision of Laskin C.J. in Capital Cities Comm. v. C.R.T.C., [1978] 2 S.C.R. 141 which I referred to as a 5-4 decision going the “other way”. That’s wrong. In fact Laskin C.J. spoke for six members of the Court in a 6-3 decision. Sorry for the error.
